Plane Crash MDL Outside US Jurisdiction: TACA

Law360 (April 1, 2009, 12:00 AM EDT) -- TACA International Airlines SA has filed a motion to dismiss damages claims by 22 plaintiffs in multidistrict litigation over injuries and other losses sustained in a 2008 plane crash in Honduras, saying the U.S. court lacks jurisdiction.

In its motion, filed Tuesday in the U.S. District Court for the Southern District of Florida, TACA claimed that because the Warsaw Convention governs international travel, any court in the United States would not be an appropriate forum for actions related to the crash.
