Monini Wins Toss Of False Ad Suit Over Truffle Olive Oil
Law360, New York (August 4, 2017, 2:02 PM EDT) -- A New York federal judge said Thursday that consumers who alleged they were duped into believing Monini’s truffle-flavored olive oil contained actual truffles could not show they had been misled, as the listed ingredients did not include truffles, dismissing the proposed class action.
U.S. District Judge Louis L. Stanton said that a reasonable consumer would not be confused as to whether the product contained truffles, given that the ingredients were clearly stated.
