Landmark Pension Case Headed For Supreme Court

Law360, New York (September 5, 2006, 12:00 AM EDT) -- A closely watched lawsuit over International Business Machine Corp.'s cash-balance pension plan is likely headed for the Supreme Court after a federal appeals court refused to reconsider the case.

On Friday, a federal appeals court in Chicago denied a petition “en banc” in the class action, which had asked all 11 active judges on the bench to review the opinion.

Three of the appellate court judges had ruled earlier in August that the IBM plan does not discriminate against older workers.
