Schering To Appeal Outside Sales Issue In OT Suit

Law360 (April 20, 2009, 12:00 AM EDT) -- A federal judge has granted Schering-Plough Corp.'s request to file an interlocutory appeal in a putative overtime class action brought by former pharmaceutical sales representatives, finding that the issue of the “outside sales exemption” is ripe for ruling by the U.S. Court of Appeals for the Second Circuit.
