ITC Must Rethink Philips CD Case Ruling: Fed. Circ.

Law360 (April 20, 2009, 12:00 AM EDT) -- A federal appeals court has revived an argument alleging U.S. Philips Corp. entered into an illegal agreement with Sony Corp. to suppress the development of an alternative technology for making recordable compact discs.

The U.S. Court of Appeals for the Federal Circuit on Monday reversed a decision by the U.S. International Trade Commission that had rejected the argument, finding that the commission had based its conclusion on legal errors and needed to take a closer look at the possibility of such an agreement.
