DOL To Appeal Invalidation Of White Collar Overtime Rule

By Braden Campbell (October 30, 2017, 8:55 PM EDT) -- The U.S. Department of Labor will ask the Fifth Circuit to undo a Texas federal judge's August order blocking a 2016 rule that more than doubled the salary level under which workers must be paid for overtime, according to an appeal notice filed Monday.

The agency said in a news release that it would ask the Fifth Circuit to hold the appeal in abeyance "while the Department of Labor undertakes further rulemaking to determine what the salary level should be," but provided no details in a bare-bones appeal notice.
