Server Loses 'Tip-Credit' Wage Suit Against TGI Friday's

Law360, Philadelphia (November 3, 2017, 6:46 PM EDT) -- A Pennsylvania federal judge tossed a former TGI Friday’s server’s proposed Fair Labor Standards Act class action against the company Thursday, finding the restaurant chain had properly informed him that, in accordance with the statute, it would be crediting his tips toward its minimum wage obligations.

U.S. District Judge Curtis Joyner said the evidence in the case did not support plaintiff Adam Calabrese’s allegations that he had never been told about the “tip credit” policy while working at restaurant locations in Pennsylvania and New Hampshire. The...
