Sepracor Sues Mylan Over Generic Lunesta Plans

Law360, New York (April 23, 2009, 12:00 AM EDT) -- Pharmaceutical company Sepracor Inc. has sued rival Mylan Inc. for seeking to make a generic version of Sepracor's insomnia drug Lunesta, which Sepracor claims would infringe its patents.

In a complaint filed Wednesday in the U.S. District Court for the Southern District of New York, Sepracor accused Mylan and its subsidiary AlphaPharm Pty. Ltd. of infringing four patents by filing an abbreviated new drug application with the U.S> Food and Drug Administration to make a generic version of Lunesta in 1, 2 and 3 mg dosages....
