Kohl's Shoppers' Misleading-Discount Suit Can Proceed

Law360, Los Angeles (November 20, 2017, 5:21 PM EST) -- A California judge on Monday declined to toss claims accusing Kohl’s Department Stores Inc. of misleading customers with the application of its Kohl's Cash discounts, saying the pleadings in a putative class action are sufficient enough to proceed.

The national retail chain had filed a demurrer to a complaint brought by Crystal Waters and Tony Valenti that claims the Kohl’s Cash rewards program misleads consumers by taking off $10 after other discounts were applied.
