Whistleblower Case v. Pfizer Dismissed

Law360 (September 11, 2006, 12:00 AM EDT) -- A whistleblower’s allegations that pharmaceutical giant Pfizer Inc. promoted a top drug for unapproved uses were shot down Monday after a federal judge ruled the court doesn’t have jurisdiction.

The lawsuit, filed by a former marketing vice president at Pfizer, accused the company of illegally marketing a successful biotechnology drug, the human growth hormone Genotropin.

Pfizer filed a motion to dismiss the case on Aug. 30, arguing that the complaint filed by Dr. Peter Rost lacked subject matter jurisdiction and failed to plead fraud with particularity....
