6th Circ. Sides With B&N, Amazon In Erotic Book Cover Suit

Law360, New York (November 21, 2017, 8:49 PM EST) -- The Sixth Circuit on Tuesday sided with Amazon.com and Barnes & Noble in a couple’s lawsuit over the sale of a parody erotica novel involving a New England Patriots football player that used their engagement photo on the cover, saying the companies cannot be held liable for the alleged actions of the author. 

A three-judge panel said the district court correctly found that the unnamed couple — identified as John and Jane Roe — failed to demonstrate that Amazon, Barnes & Noble and Smashwords Inc. gained some sort of value through the use of their images on the book cover. ...
