What's Next After Calif. Homeowner Bill Of Rights Sunsets

By Ashley Fickel (November 22, 2017, 11:52 AM EST) -- On Jan. 1, 2018, certain provisions, including those involving borrower communications and "dual tracking," of the California Homeowner Bill of Rights (HBOR) are scheduled to sunset. California's nonjudicial foreclosure statutes were significantly reformed on Jan. 1, 2013, with the enactment of the HBOR. The reforms were instituted on the heels of the February 2012 National Mortgage Servicing Settlement between the states attorneys' general and the five largest mortgage servicers and at a time when California homeowners were continuing to seek modifications of their home loans in significant numbers. Although many of the HBOR's changes were permanent, certain provisions will expire on Jan. 1, 2018, which will result in the following changes in the requirements for those servicing large portfolios of residential mortgage loans....
