Adaptive Loses Bid To Add Partner To Overcharge Suit

Law360 (April 28, 2009, 12:00 AM EDT) -- Online marketer Adaptive Marketing LLC has lost a bid to rope its marketing partner into a putative class action alleging it overcharged the credit cards of thousands of subscribers in its retail discount membership programs without their permission.

In a memorandum and order filed Friday in the U.S. District Court for the Southern District of Illinois, Judge Michael Reagan dismissed Adaptive's third-party complaint seeking judgment that its marketing partner West Direct LLC was liable for part or all of any recovery in the action.
