Pharma Marketers Can't Escape Tricare Kickback Suit

Law360, Nashville (November 29, 2017, 8:24 PM EST) -- A Florida federal judge on Tuesday rejected several defendants’ attempts to dismiss allegations they received kickbacks to steer Tricare beneficiaries to participate in a fraudulent billing scheme, saying a whistleblower had adequately alleged the illegitimacy of the claimed “marketing” payments.

Relator Brady McFarland had sufficiently pled his claims that pharmaceutical sales company Mediverse LLC and pharmaceutical sales representatives Wayne Wilkerson and Melonie Kotchey had received millions of dollars in kickbacks for their efforts to find and steer Tricare beneficiaries toward participating in an unnecessary billing scheme...
