BLM Will Fight Methane Enforcement Ruling At 9th Circ.
Law360, New York (December 5, 2017, 4:37 PM EST) -- The Bureau of Land Management on Monday said that it will appeal to the Ninth Circuit an October ruling from a California federal magistrate judge that reactivated Obama-era regulations limiting methane gas emissions on public lands.
The BLM filed a notice of appeal of U.S. Magistrate Judge Elizabeth D. Laporte's decision that said the bureau had no authority to revoke the rule months after it took effect in January in part because the agency hadn't considered the benefits of the rule in its rationale to pause its enforcement. That decision granted summary judgment to a host of conservation and tribal citizens...
