Inventor's Re-Exam Suit A Federal Issue: Calif. Court

Law360, New York (May 1, 2009, 12:00 AM EDT) -- A California state appeals court has vacated a ruling in favor of Sheppard Mullin Richter & Hampton LLP related to patent re-examination requests it made on behalf of its clients in several suits filed by inventor Lawrence Lockwood, ruling that the suit is subject to federal, not state, jurisdiction.

The California State Court of Appeals for the Second District vacated the judgment to the Los Angeles County Superior Court, ordering that the action be dismissed for lack of subject matter jurisdiction.
