Sears Workers Win Class Cert. In ERISA Action

Law360, New York (May 1, 2009, 12:00 AM EDT) -- A federal judge has certified a class in an Employee Retirement Income Security Act suit by Sears Holdings Corp. workers who claim they lost benefits when they were transitioned to a Sears home improvement subsidiary, though the certified class is smaller than the plaintiffs had sought.

Judge Arthur J. Tarnow of the U.S. District Court for the Eastern District of Michigan on Thursday certified a class of 88 employees who filed a claim for severance benefits after the transition.
