9th Circ. OKs Beauty School Escape From Student Wage Suit
Law360, New York (December 19, 2017, 9:56 PM EST) -- A Ninth Circuit panel Tuesday affirmed a California federal court's dismissal of a suit from three beauty school students, agreeing with the lower court that the putative class of students should not receive compensation from their school for labor completed in pursuit of a degree.
In a unanimous published decision penned by U.S. Circuit Judge Mary M. Schroeder, the panel agreed with the lower court's application of a test, established in the Glatt v. Fox Searchlight Pictures Inc. case, which is used to determine whether an intern is considered an employee.
