Arista Says Usenet Should Be Booted For Misconduct

Law360 (May 5, 2009, 12:00 AM EDT) -- The 14 recording companies — including Arista Records LLC, Sony BMG Music Entertainment and Virgin Records America Inc. — suing the electronic bulletin board service Usenet.com Inc. for allowing users to post copyrighted music files are seeking terminating sanctions against Usenet for what the record companies term “extreme misconduct.”

In a motion filed Monday in the U.S. District Court for the Southern District of New York, the plaintiffs allege that Usenet has engaged in “massive spoliation of evidence and other pervasive litigation misconduct.”
