Law360, New York (March 17, 2017, 10:48 AM EDT) -- As more than eight years has passed since the dawn of the financial crisis, one "hot button" issue in mortgage foreclosure litigation that continues to get a great deal of attention is the statute of limitations defense. The statute of limitations defense is being raised in an increasing number of cases across New York state by borrowers as lenders recommence litigation against borrowers after, in many instances, prior foreclosure litigation commenced by the lender or a predecessor mortgagee was discontinued or dismissed.
