High Court's Input Sought In Intel's ERISA Dispute
Law360 (March 29, 2019, 7:20 PM EDT) -- The National Association of Manufacturers, the ERISA Industry Committee and other industry groups backed two Intel Corp. retirement plans asking the U.S. Supreme Court to take up a case over when the statute of limitations for Employee Retirement Income Security Act claims begins to run.
In their amicus brief Thursday, the organizations, which also included the American Benefits Council and the American Retirement Association, told the high court that the Ninth Circuit upended ERISA's three-year statute of limitations when it ruled that providing participants with plan documents didn't create "actual knowledge" under ERISA.
