Eye On ERISA: Q&A With Cohen & Buckmann's Carol Buckmann

Law360 (June 2, 2020, 8:39 PM EDT) -- Cohen & Buckmann PC co-founding partner Carol Buckmann doesn't agree with Monday's U.S. Supreme Court win for U.S. Bank, which is expected to reduce class actions against fully funded pension plans and potentially cut back on ERISA litigation in general.

"I think the decision was wrong, the analysis was wrong," said Buckmann, who has been an Employee Retirement Income Security Act and employee benefits attorney for over 35 years. "The result wasn't necessarily surprising … but the sweeping language and the rejection of the common law of trusts as a basis for the decision was surprising."
