NEC Tells 9th Circ. Jaco Must Arbitrate Price-Fixing Claims

Law360, New York (June 27, 2012, 7:39 PM EDT) -- NEC Corp. on Tuesday told the Ninth Circuit that Jaco Electronics Inc. must arbitrate all claims related to multidistrict litigation allegations that NEC fixed prices on liquid crystal display panels, saying Jaco is attempting to override the “clear and explicit” language of their contract.
