Calif. Attys Can Rep Marijuana Dispensaries, SF Bar Says

Law360, New York (June 23, 2015, 4:19 PM EDT) -- California lawyers can ethically represent clients who want to set up medical marijuana dispensaries despite the fact that doing so might violate federal laws, the Bar Association of San Francisco has determined.

California and federal laws are at odds on the issue of medical marijuana, and helping clients set up medical marijuana dispensaries puts lawyers in a difficult position between ethical conduct and illegal conduct, but the association found in its June opinion that lawyers can help set up dispensaries so long as they advise their clients of the potential liability under federal law.
