Tempur-Sealy Mattress Buyers Class Cert Claims Bounced

Law360, Los Angeles (September 30, 2016, 9:39 PM EDT) -- A California federal judge on Friday refused to grant certification to a class of Tempur-Pedic mattress buyers accusing the bedmaker of lying in marketing materials about harmful fumes wafting from the beds that made some customers sick.

U.S. District Judge Jon S. Tigar found that Tempur-Sealy International Inc. didn’t run the marketing campaigns for each of the tens of thousands of retailers that sold its beds, so the customers couldn’t prove they’d been exposed as a class to the same false advertising when making their purchases,...
