Insurer Not Liable For Clinic's Meningitis Outbreak Suits
An Indiana federal judge on Tuesday ruled that Westfield Insurance Co. does not have to defend or indemnify an Indiana clinic, its operators or its surgeons in malpractice and negligence suits related to a deadly fungal meningitis outbreak in 2012, because the claims against them constitute professional services errors not covered under their injury and umbrella policies.
