The owner of a chemical storage facility in Texas and plaintiffs seeking damages for injuries they allegedly incurred from a 2019 chemical fire told a state federal court they are close to settling the litigation, shortly after a magistrate judge rejected the company's attempt to defeat the plaintiffs' gross negligence claims.

A Texas federal judge said the American branch of an industrial parts company should be free of claims resulting from a 2019 fire at a Deer Park chemical plant, writing that evidence indicates only its Japanese counterpart should face manufacturing defect claims over a part used at the facility.

Chemical Plant, Residents Spar Over Class Cert. In Fire Suit
Attorneys for a Harris County, Texas, chemical plant and a group of residents who say their properties were affected by a 2019 fire at the company's Deer Park facility clashed Tuesday over whether the group should be granted class certification, with the residents arguing any property within an 84-square mile radius was damaged by particulate matter that drifted from the blaze.
