LaSalle Workers Score Certification In Wage Theft Suit
Law360 (March 1, 2019, 7:53 PM EST) -- An Illinois federal judge on Thursday granted partial certification to a class of workers in a collective action alleging assisted living facility operator LaSalle Group skirted wages by deducting lunch breaks from employees pay, regardless of if they took a break or not.
U.S. District Judge Harry D. Leinenweber granted conditional certification to the class of workers but limited the parameters of members who can opt in to those who were shorted wages based on LaSalle's lunch deduction policy. The ruling is a deviation from the proposed certification that would have applied to all hourly wage earning employees.
