Apple Ducks False Ad Suit Over Defective IMac Displays

Law360, New York (March 17, 2014, 2:31 PM EDT) -- A California federal judge on Friday tossed a proposed class action accusing Apple Inc. of falsely marketing its 2009 iMac desktop computers as superior despite knowing a defect rendered half of the computers’ displays dark and essentially useless.

U.S. District Judge Edward M. Chen found that plaintiff Corbin Rasmussen failed to adequately allege either that his 27-inch iMac had a defect which Apple had a duty to disclose or that the alleged defect was “contrary to” any actionable representation actually made by Apple.
