GNC Evades False Ad Action Over Amino Acid Supplements

Law360, New York (May 28, 2014, 1:21 PM EDT) -- A California federal judge on Tuesday threw out a proposed class action accusing GNC Corp. of falsely hawking a line of dietary supplements as helpful in building muscle size, finding no indication the suit qualified for federal jurisdiction.

Benitez determined that plaintiff Stephanie Hirmez had failed to show that the potential consumer losses from GNC’s allegedly deceptive advertising of oral L-arginine supplements exceeded the $5 million amount in controversy threshold necessary to activate federal jurisdiction under the Class Action Fairness Act....
