Texas Panel Says It Can't Hear Weevil-Infested Pecans Suit

Law360 (May 16, 2019, 5:09 PM EDT) -- A Texas appellate panel has dismissed a Canadian confectioner's suit against a Georgia-based nut supplier over weevil-infested pecan bits, determining that Texas courts do not have the authority to rule on the case.

A Fifth Court of Appeals panel found Tuesday that the fact that Golden Peanut Co. LLC has operations and consumers who eats pecans in Texas isn't enough for it to exercise jurisdiction over the company, because the majority of its operations are outside the state.
