STIPULATION OF DISMISSAL WITH PREJUDICE: IT IS HEREBY STIPULATED AND AGREED, by and between Plaintiff Steven Strang and Opt-Ins Mark Golan, Peter Lavecchia, Timothy Whitsitt, Brian Pehrson, Terrald Jensen, Paul Ferry, Jeffrey Vose and Thomas Vose, and Defendants Convergent Media Systems Corporation and Ballantyne Strong, Inc., through their undersigned counsel, that pursuant to Rule 41(a)(1)(A)(ii) of the Federal Rules of Civil Procedure, this action (and all claims and causes of action that were or could have been asserted in it) are hereby withdrawn, discontinued and voluntarily dismissed, with prejudice; without costs or attorneys' fees to any party.
