MINUTE ORDER It is hereby ORDERED that Plaintiff's Motion to Establish Procedures for Filing Sensitive Third-Party Patient Evidence Under Seal Pursuant to Fed. R. Civ. P. 5.2 and D.C.COLO.LCivR 7.2 (ECF No. 58 ) is GRANTED to the extent that D.C.COLO.LCivR 7.2 generally allows the type of patient records described in the motion to be filed under restriction. However, all documents filed under restriction must be accompanied by a motion that complies with the requirements of D.C.COLO.LCivR 7.2(c). It is further ORDERED that Plaintiff's Emergency Order for Expedited Forensic Discovery Pursuant to Fed. R. Civ. P. 26(d)(1) (ECF No. 59 ) is DENIED. Plaintiff asks the Court to order Defendants to disclose certain information within 14 days and to issue a preservation order prohibiting the deletion or modification of electronically stored information ("ESI"). Defendants and their counsel are on notice about the duty to preserve relevant documents, including electronic documents and data. A failure to preserve relevant ESI may result in sanctions.
