For the reasons stated on the record, the parties joint proposed schedule at DE 46 is APPROVED as follows: (1) automatic disclosures required by Federal Rule of Civil Procedure 26(a)(1) by 6/23/2026; (2) fact discovery by 12/25/2026; (3) exchange of expert report(s), if any, by 1/25/2027; (4) expert discovery by 3/1/2027; (5) all discovery by 3/8/2027; and (6) the final date to take the first step in dispositive motion practice, if any, consistent with the Individual Practice Rules of District Judge Sanket J. Bulsara, is 4/9/2027. The Court currently declines to set a deadline for the completion of preliminary discovery or schedule a date for an initial settlement conference.Additionally, any motion to amend the pleadings to add claims or join additional parties must be filed by 10/12/2026. Any such motion filed on or after 10/13/2026 will be denied absent a showing of good cause under Fed. R. Civ. P. 16(b)(4). See Sacerdote v. New York University, 9 F. 4th 95, 115 (2d Cir. 2021).The above-mentioned schedule does not apply to Defendant American Express Company (Amex). The parties shall submit a joint letter by 7/17/2026 regarding their positions on a discovery stay as to Defendant Amex. The Court HOLDS IN ABEYANCE Defendant Amexs request for a discovery stay pending submission of the joint letter on 7/17/2026.
