Recycling Co. Asks 9th Circ. To Make Reno Face Antitrust Suit

Law360 (June 17, 2019, 5:51 PM EDT) -- A Nevada recycling company has asked the Ninth Circuit to overturn a ruling by a federal judge that dismissed its lawsuit against rivals and the city of Reno for allegedly monopolizing the market for recyclable materials.

Green Solutions Recycling LLC told the court Friday that its suit accusing Reno, Refuse Inc., Reno Disposal Co. Inc. and Waste Management of Nevada Inc. of allegedly shutting it out of the market was improperly dismissed because the city is not immune from the Sherman Antitrust Act.

The district court also incorrectly ruled that Nevada did not have to supervise Reno's conduct because "waste disposal"...
