Jury Hits Del Monte With $13M Verdict In Licensing Dispute

Law360, New York (April 6, 2012, 10:59 PM EDT) -- A New York federal jury determined Friday that preserved fruit company Del Monte Foods Co. misled consumers with its refrigerated products and awarded Fresh Del Monte Produce Inc. $13.15 million for the alleged mislabeling and for breach of a trademark licensing agreement between the companies.

Following a six-day trial, the jury found for plaintiff Fresh Del Monte, which alleged that Del Monte had violated the Lanham Act with misleading labels, had breached the trademark licensing agreement and had engaged in unfair competition. The jury awarded $7.2...
