Firm Misled Homeowners About Foreclosure Rights, Suit Says

Law360, Miami (January 28, 2014, 7:13 PM EST) -- A Florida couple on Tuesday filed a putative class action against Atlanta-based law firm Weissman Nowack Curry & Wilco PC alleging the firm violated the Fair Debt Collection Practices Act by misleading them about their rights in a foreclosure proceeding.

In a suit filed in the Southern District of Florida, Carlos M. Fraga and Sabrina Fraga claim the firm served the couple a foreclosure complaint filed against them on behalf of Flagstar Bank NA and attached a notice saying that the debt described in the complaint would be assumed valid unless the couple were to dispute its validity within 30 days....
