Solar Power Co. Can't Disconnect TCPA Suit Over Robocalls
Law360 (April 10, 2019, 7:48 PM EDT) -- Energy company Horizon Solar Power can't hang up on a proposed class action lawsuit over alleged robocalls, after a Massachusetts federal judge ruled Tuesday that the company appeared to have used an automated dialer in violation of the Telephone Consumer Protection Act.
U.S. District Court Judge F. Dennis Saylor IV denied Horizon Solar Power Inc.'s motion to dismiss the lawsuit brought by William Gonzalez and Jeremiah Davila-Lynch, partly on the grounds that the proposed lead plaintiffs described unsolicited sales calls to their cell phones using what appeared to meet the TCPA's murky definition of a banned Automated Telephone Dialing System....
