5th Circ. Axes OT Verdict For Oil Service Employees

Law360 (May 16, 2018, 7:02 PM EDT) -- The Fifth Circuit on Wednesday upended a jury’s determination that oil well services provider Crest Pumping Technologies LLC illegally denied two workers overtime, ruling that the company was exempt from overtime requirements under the Fair Labor Standards Act.

In a published opinion, a three-judge panel reversed a Texas federal jury’s verdict in favor of former Crest employees Scot Carley and Brandon Brown, who had won a decision that they had wrongfully been denied overtime pay in violation of the FLSA.
