2nd Circ. Revives Macy's' Bid To Arbitrate Disability Bias Suit

Law360 (July 12, 2018, 9:48 PM EDT) -- The Second Circuit on Thursday wiped out a lower court’s decision that Macy’s couldn’t arbitrate a former employee’s suit alleging he was fired because of his learning disability, but said the trial court must now figure out if he actually received a form in the mail that would have allowed him to opt out of the retailer’s arbitration program.
