American Airlines Can't Sell Magistrate On Atty Sanctions

Law360 (September 11, 2019, 11:52 AM EDT) -- A Florida federal magistrate judge has declined to back sanctions against attorneys for a pilot suing American Airlines, saying even though the pilot gave false information in a deposition, he did so because of a misunderstanding and his attorneys tried to correct the record.

U.S. Magistrate Judge Alicia M. Otazo-Reyes said in a recommendation Tuesday that retired Lt. Col. Rodney Scott Patterson gave bad information during a deposition about a doctor’s report that undercut his claims, but that he had been under the impression that the report was subject to attorney-client privilege and later admitted he misspoke.
