Free Beer Perk Should Up Anheuser Workers' OT, Suit Says
Law360, New York (August 19, 2013, 12:30 PM EDT) -- A putative class of California brewery workers hit Anheuser-Busch LLC on Friday with a suit accusing the company of denying them proper overtime wages, alleging that payment in free beer and other perks were unfairly excluded in pay-rate calculations, lowering the overtime payment.
The U.S. subsidiary of Belgium parent Anheuser-Busch InBev NV failed to include so-called “incentive payments” — which included free and discounted beer — when calculating overtime owed to employees at its Van Nuys, Calif., brewery, according to the suit filed in California state court.
