Individual Settlement Kills PAGA Claims, Calif. Judge Says

By Vin Gurrieri (August 19, 2016, 7:19 PM EDT) -- A California state judge has dismissed claims against a restaurant operator brought under the state's Private Attorney General Act, ruling that an individual settlement of claims brought under the state's labor code was the equivalent of summary judgment on PAGA claims.

In a Tuesday order, Judge Kenneth Freeman granted a motion by Reins International California Inc. for summary judgment on PAGA claims brought by employee Justin Kim, who had previously settled his individual claims accusing his employer of wage and hour violations.
