Oil Workers' Overtime Claims Barred By CBA, 9th Circ. Says
Law360 (January 28, 2019, 6:13 PM EST) -- The Ninth Circuit ruled Friday that unionized offshore oil rig workers can't pursue an unpaid-overtime claim because it's barred by the Labor Management Relations Act, but that the lower court jumped the gun in similarly nixing claims over meal breaks and other violations.
In a published ruling, a three-judge panel partially upheld U.S. District Judge Otis D. Wright's dismissal of a suit by plaintiffs Carl Curtis and Arthur Williams accusing Irwin Industries Inc. of stiffing workers on overtime, meal breaks and various other violations of the California Labor Code.
