Fed. Circ. Affirms PTAB Ax Of Baker Hughes Oil Well Patent

Law360 (May 15, 2019, 3:59 PM EDT) -- The Federal Circuit on Wednesday shot down Baker Hughes Oilfield Operations LLC’s attempt to revive a well-coating patent invalidated by the Patent Trial and Appeal Board.

The three-judge panel affirmed the PTAB’s November 2017 ruling without comment, in a win for challenger Packers Plus Energy Services Inc. The board had invalidated all 20 of the patent’s claims as obvious or anticipated by prior art.

Baker Hughes had sued Packers Plus in Texas federal court for infringement in January 2016, leading Packers Plus to ask the board to review the four patents asserted against it. The board instituted inter partes review on...
