DC Circ. To FERC: Tell How Gas Exports Justify Nexus Line

Circuit on Friday told the Federal Energy Regulatory Commission to go back and try again to explain how gas for foreign export from the Nexus Gas Transmission LLC’s $2.1 billion pipeline could be used to justify the project's need and the taking of private property.

The panel did not throw out the certificate issued for construction of the pipeline but did side with landowners who raised questions about why shipments to Canada could help show why the pipeline was necessary and worth giving the company power to exercise eminent domain for its construction.
