FERC Wants DC Circ. To Put $3.5B Pipeline Fight On Hold

Law360 (February 21, 2018, 8:13 PM EST) -- The Federal Energy Regulatory Commission asked the D.C. Circuit on Tuesday to put litigation fighting the approval of the $3.5 billion Mountain Valley gas pipeline on hold so that the agency can first consider activists' requests that it revisit the decision.

FERC wants a court case challenging a certificate of public convenience and necessity it gave for the pipeline held in abeyance so that it can address the “numerous and complex matters” raised by environmentalists and landowners in their requests for rehearing. In February, the court refused...
