Halliburton Seeks Ax Of Medical Monitoring Claim In Nuke Suit

Law360, New York (July 9, 2012, 5:21 PM EDT) -- Halliburton Co. asked an Oklahoma federal court on Friday to end a demand for medical monitoring in a putative class action alleging the company exposed a town's residents to nuclear waste and other toxic substances, saying state law doesn't allow the claim.

Medical monitoring remedies are precluded in the suit, as the only claims remaining involve Oklahoma tort law, which does not allow plaintiffs to assert claims for medical monitoring, Halliburton said. Allowing such a claim would both expand the state’s tort law and go against...
