Costa Rica Property Investors Fight ICSID Award Redo

Law360, Washington (May 17, 2017, 7:51 PM EDT) -- U.S. real estate investors Wednesday asked a D.C. federal court for an emergency injunction to block an International Centre for Settlement of Investment Disputes tribunal from issuing a corrected award in a dispute over property the Costa Rican government took for a national park.

The arbitration tribunal’s decision to issue an amended award over an “error of omission” is time-barred under United Nations Commission on International Trade Law rules, Brett Berkowitz and sons Trevor and Aaron Berkowitz told the court. They asked for an emergency injunction...
