Stipulation and Order ~Util - Set Deadlines
STIPULATION AND SCHEDULING ORDER GOVERNING PHASE 2 EXPERT DISCOVERY: NOW THEREFORE, IT IS HEREBY STIPULATED AND AGREED, by and among the parties, through their undersigned counsel, that the following deadlines shall apply in this action: 1. Phase 2 Expert Discovery a. Every party-proponent that intends to offer expert testimony concerning Phase 2 issues must make the disclosures required by Federal Rule of Civil Procedure 26(a)(2) by April 15, 2027. b. Every party-opponent that intends to offer expert testimony concerning Phase 2 issues must make the disclosures required by Federal Rule of Civil Procedure 26(a)(2)by October 15, 2027. c. All Phase 2 expert discovery, and depositions of Phase 1 experts not already taken during Phase 1, shall be completed by December 17, 2027. 2. Post-Phase 2 Motions: No later than one week after the close of Phase 2 expert discovery, or at a time otherwise ordered by the Court, counsel for all parties shall file a joint status letter and notify the Court if any party anticipates filing a motion for summary judgment that is not duplicative of its post-Phase 1 summary judgment motion and/or a motion to exclude testimony of experts pursuant to Federal Rules of Evidence 702705 and the Daubert v. Merrell Dow Pharmaceuticals, Inc., 509 U.S. 579 (1993) line of cases, and if so, the parties shall set forth a proposed briefing schedule for any such motion(s). See ECF No. 215 at paragraphs 11-12. 3. Other than the deadlines in Paragraphs 1 and 2 above, all other deadlines in the Scheduling Order and any amendments thereof remain the same. SO ORDERED.
